2019 is an eventful year. G20 endorsed the ambitious work programme relating to tax challenges arising from digitalization that consists of two pillars. IRD issued or rewrote a few departmental notes, including the ones on transfer pricing documentation, transfer pricing between associated persons and attribution of profits to permanent establishment in Hong Kong. Hong Kong signed the Fifth Protocol to the Arrangement for Avoidance of Double Taxation with the Mainland of China which incorporates a Teachers Article. The Multilateral Convention to Implement Tax Treaty Related Measures to Prevent BEPS will be implemented in Hong Kong. IRD has recently completed its departmental information technology plan study and plans to introduce e-filing for profits tax returns with financial statements attached in iXBRL format. With tax information obtained under AEOI and CbC reporting, operations within IRD will be changed and annual submission of profits tax returns for all businesses will be required. All these new developments and changes will impact tax practitioners in Hong Kong who need to make timely preparation.

Mr. Chiu joined the Inland Revenue Department after finishing his study in accountancy at Hong Kong Polytechnic University in 1983. His current portfolio includes international taxation, tax appeals, technical research, advance ruling, charitable donations, internal audit and complaints. Mr. Chiu also oversees the Individuals Tax Unit and the Profits Tax Unit. He is the head of the Hong Kong delegation in a number of tax treaty negotiations and has the overall responsibility of the work of the Tax Treaty Section. He is closely engaged in the work on AEOI and BEPS. Mr. Chiu is a member of HKICPA, ACCA, ICAEW and TIHK.
Mr. Benjamin Chan Sze Wai, Chief Assessor (Tax Treaty)
Mr. Chan joined the Inland Revenue Department after finishing his study in accountancy at the Chinese University of Hong Kong in 1998. His current portfolio covers various matters concerning international taxation, including AEOI, BEPS, mutual agreement procedure and advance pricing arrangement. Mr. Chan has been engaged in formulating the implementation strategies for BEPS in Hong Kong. He took forward the enactment of the Inland Revenue (Amendment) (No. 6) Ordinance 2018, which introduces various provisions relating to transfer pricing and international taxation into the Inland Revenue Ordinance. Mr. Chan is a member of HKICPA.
