This seminar will cover new tax legislative and case law developments in Hong Kong for the past year as well as the Inland Revenue Department’s (IRD) interpretation of the relevant laws as stated in new practice notes or through other forums.


Seminar highlights


l  Legislative developments:

·   Legislation implementing the Base Erosion and Profit Shifting (BEPS) initiatives, including transfer pricing legislation, codification of the Sharkey v Wernher principles and introduction of a proposed controversial deeming provision for the taxation of intellectual property rights.

·      Two-tiered profits tax rates regime

·      Expanding the scope of profits tax deductions for capital expenditure incurred for the purchase of three more types of intellectual property rights   

l  Case law development:

·     CIR v Perfekta Enterprises Limited – change of intention: why taxpayers were required to pay tax when they actually suffered losses from the redevelopment?

·    CIR v Right Margin Limited – whether and when a debt can be considered bad for tax deduction purposes? What was on the mind of the IRD when it decided to appeal against the Board of Review decision?

l  Updates on IRD practice:

·      Recent developments on the section 39E issue

·    Tax treatment of lease payments incurred by a lessee under a new accounting standard

Mr. Patrick Kwong, Executive Director, Tax & Business Advisory Services, EY

Mr. Patrick Kwong has more than 30 years of tax experience advising clients across various industries and sectors. He is a past president and current Adviser of the Taxation Institute of Hong Kong. Patrick is also a member of the Joint Liaison Committee on Taxation, which is a forum for discussion between revenue officials, legislators, tax practitioners and other relevant bodies on tax related technical matters and legislation. Patrick is a regular speaker at tax seminars and conferences and has authored a number of tax articles published in various professional journals and magazines.

Ms. Kathy Kun, Senior Manager, Tax & Business Advisory Services, EY

Kathy is a Senior Manager of the National Tax Centre of EY with over 10 years of experience. She is responsible for developing and updating tax training materials, as well as conducting internal tax training courses. She is a frequent speaker at tax seminars and is one of the authors of the Firm’s tax client publications.
